KeySwap is operated from Belgium by Metix and offered to landlords and tenants in the US. US consumer-protection laws vary by state and apply to consumers in their state. These Terms govern the contract you enter into with KeySwap, without limiting any mandatory consumer-protection rights that apply to you under the law of your state of residence.
These Terms of Service (the "Terms") apply to all agreements entered into between KeySwap and its customers (the "User") relating to the use of the web application at keyswap.immo.
By checking the "I accept the Terms of Service" box during the checkout process, the User accepts these Terms fully and unconditionally.
KeySwap provides a digital web application that lets the User independently complete a move-in or move-out checklist documenting the condition of a rental property at the start and end of a lease.
What the service does NOT include: KeySwap is not a licensed home inspector, an attorney, or a legal advisor. The document generated through KeySwap is a tool — the User remains responsible for the accuracy and completeness of the information entered. KeySwap does not provide any structural inspection, energy assessment, or legal certification. Landlord-tenant law varies by state; KeySwap provides general information only and not legal advice for any specific state.
The price to generate a checklist document is $9.00 (one-time purchase).
Payments are processed through Stripe, Inc. We accept Visa, Mastercard, and other methods offered by Stripe. Payment data is never stored on our servers — all payment transactions are handled within Stripe's secure environment.
After a successful payment, the User immediately receives access to print and save the document.
Because KeySwap delivers digital content, access to the generated document begins immediately after payment is completed. By checking the box provided during checkout, the User expressly confirms that:
If you experience a technical problem that prevents you from receiving your document, contact us at info@keyswap.immo and we will work to resolve it. Nothing in this section limits any non-waivable refund or cancellation rights you may have under the consumer-protection laws of your state.

To the fullest extent permitted by applicable law, KeySwap's total liability is in any event limited to the amount paid by the User for the service in question (a maximum of $9.00).
For serious rental disputes or contested claims — including questions about the lease, the security deposit, or amounts withheld — we recommend consulting a licensed home inspector or an attorney in your state.
The web application, design, source code, text, logo, and all other content of KeySwap are the property of the operator and are protected by applicable intellectual property laws. Copying, reproducing, or commercially exploiting them without express written permission is prohibited.
The data entered by the User and the generated document remain the sole property of the User. KeySwap claims no rights to the contents of move-in or move-out checklists.

The contents of the checklist (names, address data, photos, notes) are stored exclusively in the local storage (localStorage) of the User's browser. This data is not transmitted to or stored on KeySwap's servers, unless the User uses the AI analysis button (in which case the photos are temporarily transmitted to our AI provider for the purpose of analysis).
When the User uses the AI analysis button, the relevant photos are temporarily sent to KeySwap's backend and then to the AI provider (Google Gemini). The photos are not permanently retained. By using the AI feature, the User consents to this temporary processing.
Depending on your state of residence, you may have the right to access, correct, delete, or obtain a copy of the personal information we hold about you, and to opt out of certain uses of your information. Several US state privacy laws (for example, those in California, Virginia, Colorado, and other states) may apply to you depending on where you live. You can exercise these rights by contacting info@keyswap.immo. We do not sell your personal information.
KeySwap uses strictly necessary technical cookies (session management, payment reference). In addition, we use — only after your explicit consent via the cookie banner — Hotjar for anonymous behavior and session analysis to improve the website. Without consent, these elements are not loaded. You can withdraw your choice at any time by clearing your browser's local storage.
For certain features we rely on external providers acting as service providers (data processors). The necessary data-processing agreements are in place with these parties:

These Terms govern your use of KeySwap. Because landlord-tenant relationships are governed by the law of the state where the rental property is located, any rental dispute between a landlord and tenant is subject to that state's law. As a US consumer, you keep the non-waivable consumer-protection rights and remedies available to you under the laws of your state, and nothing in these Terms limits those rights.
KeySwap reserves the right to modify these Terms. Material changes will be announced in advance via the website. Continued use of the service after the effective date of a change constitutes acceptance of the new Terms.
