Plain-English summary: KeySwap is a digital tool that lets you carry out your own inventory. We are not a chartered surveyor or inventory clerk, and we do not provide any legal advice. You pay £9 to access the tool — not for a certified expert report.

KeySwap is operated from Belgium by Metix and offered to landlords and tenants in the UK. UK consumer protection (the Consumer Rights Act 2015) applies to UK consumers regardless. These Terms are governed by the law applicable to the contract concluded with KeySwap, without prejudice to the mandatory consumer-protection rules of the user's country of residence.

Clause 2 — Scope

These Terms and Conditions (the "Terms") apply to all contracts concluded between KeySwap and its customers (the "User") relating to use of the web application at keyswap.immo.

By ticking the box "I accept the Terms and Conditions" during the payment process, the User accepts these Terms in full and unconditionally.

Clause 3 — Description of the service

KeySwap provides a digital web application that allows the User to independently produce an inventory recording the condition of a property at the start or end of a tenancy.

What the service does NOT include: KeySwap is not a chartered surveyor, inventory clerk or legal adviser. The document generated via KeySwap is a tool — the User remains responsible for the accuracy and completeness of the data entered. KeySwap provides no structural survey, no energy performance assessment and no formal expert certification.

Clause 4 — Price and payment

The price for generating an inventory document is £9 (including any applicable VAT) as a one-off purchase.

Payments are processed via Stripe, Inc. We accept Visa, Mastercard and other methods offered by Stripe. Payment details are never stored on our servers — all payment transactions pass through Stripe's secure environment.

After a successful payment, the User immediately obtains access to print and save the document.

Clause 5 — Right to cancel and the digital-content exception

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, a consumer ordinarily has the right to cancel a distance contract within 14 days of entering into it.

Exception — digital content: the supply of the digital content begins immediately after the payment is completed. By ticking the relevant box during the payment process, the User expressly confirms that:

This exception is valid where the consumer has given express consent and acknowledgement before the digital content is supplied, and nothing in these Terms affects a UK consumer's statutory rights under the Consumer Rights Act 2015.

Clause 6 — Limitation of liability

KeySwap provides a software application as a tool and is in no way responsible for:

KeySwap's liability is in any event limited to the amount paid by the User for the service in question (a maximum of £9.00). Nothing in these Terms limits or excludes liability that cannot be limited or excluded under UK law, including the statutory rights of UK consumers under the Consumer Rights Act 2015.

For serious tenancy disputes, deposit disagreements or contested matters, we recommend consulting a chartered surveyor, an accredited inventory clerk or a legal adviser.

Clause 7 — Intellectual property

The web application, design, source code, texts, logo and all other content of KeySwap are the property of the operator and are protected by UK and international intellectual-property law. Copying, reproducing or commercially exploiting them without express written permission is prohibited.

The data entered by the User and the generated document remain the User's sole property. KeySwap claims no rights over the content of the inventories.

Clause 8 — Privacy policy and data processing (UK GDPR)

8.3 Storage of form data

The content of the inventory (names, address data, photos, remarks) is stored exclusively in the local storage (localStorage) of the User's browser. This data is neither transmitted to nor stored on KeySwap's servers, unless the User uses the AI analysis button (in which case the photos are temporarily transmitted to our AI provider for the purpose of the analysis).

8.4 AI processing

When the User uses the AI analysis button, the relevant photos are temporarily sent to the KeySwap backend and then to the AI provider (Google Gemini). The photos are not retained permanently. By using the AI feature, the User consents to this temporary processing.

8.5 Rights of data subjects

The User has the right to access, rectify, erase, restrict the processing of, object to and port their personal data. Requests can be made via info@keyswap.immo. If there is a dispute, the User may lodge a complaint with the Information Commissioner's Office (ICO).

8.6 Cookies and tracking technologies

KeySwap uses strictly necessary technical cookies (session management, payment reference). In addition, we use — only after your explicit consent via the cookie banner — Hotjar for anonymous behaviour and session analysis to improve the website. Without consent, these elements are not loaded. You can withdraw your choice at any time by clearing your browser's local storage.

8.7 External processors

For certain features we rely on external service providers who act as processors. The necessary data-processing agreements are concluded with these parties:

Clause 9 — Governing law and dispute resolution

These Terms are governed by the law of the United Kingdom. In the event of a dispute, the courts of the United Kingdom have jurisdiction. This does not affect a UK consumer's statutory rights under the Consumer Rights Act 2015 or their right to bring proceedings in the courts of their place of residence.

Clause 10 — Changes to these Terms

KeySwap reserves the right to amend these Terms. Material changes are communicated in advance via the website. Continued use of the service after the date of the change constitutes acceptance of the new Terms.
